The petitioner seeks bail in a case instituted for the offences under Sections 392 and 411 of the Indian Penal Code . The prosecution case in short is that the accused persons looted the ornaments of gold from the informant while he along with family was coming after getting treatment of his son.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.5.2019. There is no allegation of tampering of witnesses alleged against the petitioner. Chargesheet has been submitted in the present case. The petitioner has falsely been implicated in the present case due to village politics. One wrist watch is said to have been recovered from

Patna High Court CR. MISC. No.63727 of 2019(2) dt.14-11-2019 2/2 the petitioner. Except for this, there is no other incriminating articles recovered from the possession of the petitioner. It is further submitted that the petitioner may be released after completion of seven months in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R..

Considering the aforesaid facts and circumstances, on completion of seven in custody, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No. 201 of 2019.
