The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 307/34 of the Indian Penal Code.
Allegation upon the petitioners is that they along with other co-accused persons assaulted the informant by means of lathi and danda.
Learned counsel for the petitioners submits that they are innocent and have been falsely implicated in the present case. He submits that date of occurrence is 28.06.2019 and but
Patna High Court CR. MISC. No.78206 of 2019(3) dt.06-03-2020 2/2 FIR has been lodged on 02.07.2019 and there is no explanation about the said delay. He submits that the injuries upon the informant is found to be simple in nature. He further submits that the petitioners bear no criminal antecedent. In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Judge-1st Jehanabad in connection with Ghosi P.S. Case No. 233 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
