1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 316(5), 318, 338, 336, 336(3) and 3(5) of the B.N.S.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that petitioner along with other accused persons committed irregularities in completion of various schemes of the Panchayat and thus, misappropriated an amount of Rs.30 Lacs.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case being Block Panchayat Raj Officer. It is next submitted that prior to

Patna High Court CR. MISC. No.69179 of 2025(5) dt.23-12-2025 2/3 institution of the instant FIR, no opportunity was given to the petitioner to explain his side of the case. It is next submitted that had an opportunity been given to the petitioner to explain his side of the case, perhaps the petitioner would not have been implicated in the instant case. It is also submitted that no doubt, allegation is of committing irregularities in completion of various schemes under the Panchayat, but then, allegations are general and omnibus in nature. It is further submitted that one of the allegation is that a government ghat was to be constructed, but then, instead of constructing a government ghat, the amount was used for constructing a private ghat.

It is submitted that the role of the petitioner as Block Panchayat Raj Officer comes only when the measurement book is prepared and the payment is to be made. It is submitted that once measurement book is ready and payment is to be made through the contractor thereafter Pramukh along with Block Development Officer signs. It is submitted that since measurement book recorded completion of the work, as such, petitioner signed the requisite documents for making payment. It is further submitted that petitioner is in custody since 26.08.2025.

6. Considering the submissions made by the learned

No.69179 of 2025(5) dt.23-12-2025 3/3 counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/successor in connection with Parihar P. S. Case No.58 of 2025.

7. The application stands allowed.
