Petitioner is languishing in judicial custody since 09.08.2017 in connection with Kadirganj P.S. Case No. 27 of 2016 for offences punishable under Sections 304-B/34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that his daughter was killed by the petitioner, who is her husband, and other in-laws by hanging.
It has been submitted by the learned counsel for the petitioner that he is innocent, has been falsely implicated in the aforesaid case and there was some altercation between the two and
Patna High Court Cr.Misc. No.3198 of 2018 (3) dt.16-02-2018 2/2 the deceased committed suicide by hanging as ropes were found in the room where the death occurred and it was the petitioner who had telephonically informed the father of the deceased about her death.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, I am not inclined to grant privilege of bail to the petitioner at this stage in connection with Kadirganj P.S. Case No. 27 of 2016, pending in the court of learned Judicial Magistrate, 1st Class, Masaurhi, Patna.
Application is, accordingly, rejected.
