Petitioner seeks bail in connection with Sakra P.S. Case No. 226 of 2009 registered for the offence punishable under sections 447, 341, 342, 323, 324, 307 and 379 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Injury sustained has been found to be simple in nature as is evident from Annexure-2. Further, in this case cognizance has not been taken under Section 307 of I.P.C. as is evident from Annexure-3. Petitioner has no criminal antecedent and is in custody since 30.05.2018. Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.56448 of 2018(2) dt.20-09-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-cum-Sub Judge- XIII, Muzaffarpur in connection with Sakra P.S. Case No. 226 of 2009..
