Petitioner seeks bail in Special Case No.03 of 2018 arising out of Bihra P.S. Case No.85 of 2018 instituted for the offence under Section(s) 399, 402 Indian Penal Code, sections 25(1-b) a, 26, 35 of the Arms Act, Sections 3, 4 and 5 of the Explosives Substance Act and Section 20/22 of the NDPS Act. Counsel for the petitioner submits that one loaded country made pistol has been recovered from the possession of this petitioner. Petitioner is in custody since 07.05.2018. Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing

Patna High Court Cr.Misc. No.56276 of 2018 (2) dt.04-10-2018 2/2 bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Saharasa, in connection with Special Case No.03 of 2018 arising out of Bihra P.S. Case No.85 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.

The petitioner will remain present on each and every date of trial and his absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled.
