2. The petitioner seeks bail in connection with Gaurichak P.S. Case No. 165 of 2023 registered for the offence punishable under Sections 290, 336 and 302 of the Indian Penal Code and Sections 25(9) and 27 of the Arms Act.

3. As per the prosecution case, the petitioner is an accused of killing the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel further submits that neither the independent witnesses has supported the case of the informant nor they saw the petitioner firing on the deceased. Chargesheet has been submitted under Section 304 of the Indian Penal Code

Patna High Court CR. MISC. No.71497 of 2023(2) dt.07-11-2023 2/2 as the celebratory firing was made at the time of marriage. The petitioner is in jail since 17.04.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VI, Patna City in connection with Gaurichak P.S. Case No. 165 of 2023.
