JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-10-2019 The petitioner seeks bail in anticipation of his arrest in connection with Gaurichak P.S. Case No. 367 of 2018 [Spl. (POCSO) Case No. 204 of 2018], dated 05.10.2018, instituted for the offences under Sections 341, 323, 354(a), 354(c), 354(d) and 34 of the I.P.C. and Section 12 of the POCSO Act.

From the reading of the F.I.R., it appears that co-accused/Rahul Kumar is the main culprit. The petitioner's name has been taken only in the last part of

Patna High Court CR. MISC. No.63606 of 2019(2) dt.18-10-2019 2/3 the F.I.R. as a brother of aforesaid Rahul Kumar, who is alleged to have helped co-accused/Rahul Kumar in assaulting the sister of the informant.

The learned counsel for the petitioner has submitted that none of the allegations against the petitioner can at all be said to have been made out. The petitioner is also gainfully employed and his name has been dragged only to put pressure on coaccused/Rahul Kumar against whom all the allegations are directed.

Considering the facts aforestated, the petitioner/Sonu Kumar, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-I-Cum-Special Judge, POCSO, Patna in connection with Gaurichak P.S. Case No. 367
