The petitioner, who is in custody, seeks bail in connection with Bahadurpur (Pator O.P.) P.S. Case No. 99 of 2018 registered for the offence punishable under Sections 363 and 366A of the Indian Penal Code.

Allegation against petitioner is of kidnapping the victim girl with an intention to marry her.

It has been submitted on behalf of the petitioner that occurrence took place on 08.03.2018 and FIR was registered on 12.03.2018. She did not level allegation of her kidnapping at the hands of petitioner during course of investigation and in statement recorded under

Patna High Court Cr.Misc. No.56091 of 2018(2) dt.06-10-2018 2/2 Section 164 Cr.P.C. There was love affairs between petitioner and victim girl and she has willingly gone to the petitioner. She was medically examined by the doctor and has assessed her age between19-20 years. Petitioner has no criminal antecedent and he is in custody since 11.06.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Darbhanga, in connection with Bahadurpur (Pator O.P.) P.S. Case No. 99 of 2018.
