Case No. 5 of 2018, registered for the offences punishable under Sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Informant has suspected hands of the petitioner in killing his brother.

Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence and petitioner, including others are named in the FIR and only because there was election dispute between the parties he has been made accused in this case and other co-accused has been granted bail by a co-ordinate Bench of this Court by order dated 10.7.2018 passed in Cr.Misc.No. 33620 of 2018 and petitioner is in

Patna High Court CR. MISC. No.63911 of 2019(4) dt.05-02-2020 2/2 custody since 25.2.2019 and charge sheet has been submitted. Heard learned APP also.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-II, Danapur, Patna, in connection with Naubatpur P.S. Case No. 5 of 2018.
