====================================================== CORAM: HONOURABLE MR. JUSTICE A. ABHISHEK REDDY ORAL ORDER 13-11-2025 Without going into the merits or demerits of the case, the present writ petition is disposed of at the stage of admission with the consent of both the parties.

2. Learned counsel appearing on behalf of the petitioner submits that the land of the petitioner is being used for the purpose of constructing a road under the Bharatmala Project and without acquiring same. Learned counsel submits that the petitioner has given a suitable representation dated

Patna High Court CWJC No.17069 of 2025(2) dt.13-11-2025 2/3 02.04.2025 (Annexure P/6) to the District Land Acquisition Officer-cum-Competent Authority, Madhubani under the National Highways Act but the authority without passing any order on the same or disposing of the said representation are proceeding with the construction. Learned counsel therefore seeks a direction to the respondent authority to consider the said representation and pass necessary orders strictly in accordance with law.

3. Learned counsel appearing on behalf of the respondents-State as well as the respondents-National Highway Authority of India submit that they have no objection if a direction is given to the authority to consider the representation strictly in accordance with law.

4. Having regard to the same, the present writ petition is disposed of directing the Respondent No. 3, i.e., the Competent Authority NHAI Cum the District Land Acquisition Officer, Madhubani to consider the representation dated 02.04.2025 (Annexure P/6) as expeditiously as possible preferably within a period of 8 weeks from the date of receipt of the copy of this order.

5. It is needless to mention that before passing any order the petitioner shall be put on notice and given him an

Any order passed shall be communicated to the petitioner.

6. With the above directions, the present writ petition stands disposed of.
