The petitioners seek anticipatory bail in a case instituted for the offences under Sections 147, 148, 149, 353, 332, 333 and 504 of the Indian Penal Code and Section 3/4 of Prevention of Damage of Public Property Act.
Allegation has been made that some anti-social elements armed with deadly weapons have blocked the road and disturbing the road traffic of the area. When the police party reached there it was found that road was fully blocked by the vehicles. About 100-150 anti social elements were creating hindrance on the road.
Patna High Court Cr.Misc. No.56334 of 2018 (2) dt.20-09-2018 2 /2 There is no specific allegation against the petitioner. The petitioner is only member of the mob.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Vikas Kumar Poddar @ Anuj Kumar Poddar @ Anuj Poddar and Himesh Kumar Poddar @ Hitesh Kumar Poddar @ Hitesh Poddar @ Golu Kumar, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No.617 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
