The petitioners seek bail in Special Case No. 3745/2018, arising out of Bihta P.S. Case No. 395/2018, instituted for the offences under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioners has submitted that petitioner no. 1 is in custody since 25.07.2018 and petitioner no. 2 is in custody since 10.07.2018. There is no recovery from conscious possession of petitioners.
Seizure-list is part of F.I.R., which does not bear signature of independent witnesses.
Patna High Court Cr.Misc. No.56507 of 2018 (2) dt.04-10-2018 2/2 Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna in connection with Special Case No. 3745/2018, arising out of Bihta P.S. Case No. 395/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
