1. Heard learned counsel for the petitioner and Mr. Chandra Bhushan Prasad, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 126(2), 115, 118(1), 117, 109, 303(2), 352, 351(2) and 3(5) of the BNS.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that 11 named accused persons including the petitioner intercepted his cousin, namely, Birendra Yadav on 22.12.2024, at 11:00 a.m., when he was returning home after closing his shop thereafter the accused persons started assaulting him. Further, on orders of Mahendra Prasad Yadav, accused Ranju Devi and petitioner assaulted him by sharp edged weapon causing injury on his head and Jitendra Yadav assaulted Lalu

No.73377 of 2025(2) dt.17-11-2025 2/3 Yadav by rod causing injury on his body while Indrajeet Yadav assaulted Sajjan Yadav by rod indiscriminately causing fracture of his left hand thereafter petitioner and Indrajeet Yadav snatched Rs.7,000/- from Birendra Yadav while Jitendra Yadav and Nitish Kumar Yadav snatched chain and mobile of Lalu Yadav.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that on orders of Mahendra Prasad Yadav, petitioner along with Ranju Devi assaulted the cousin of the informant on his head by a sharp edged weapon causing injury. It is next submitted that allegation of assault is not specific and the injury has been opined to be simple in nature and the blow is not alleged to be repeated.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on
