2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 188 and 414 of the Indian Penal Code and Section 52 of the Prisoner's Act.
3. The allegation in the first information report is that while the petitioner was lodged in jail, three mobile SIMs were recovered from his room in the cell.
4. At the outset, it is submitted by learned counsel for the petitioner that the present case was although lodged in the year 2021 and the petitioner remained in custody in connection with Patepur P.S. Case No.169 of 2020 from 10.08.2020 to 30.03.2023 but the police did not remand him in the present case. It is further submitted that, as a matter of fact, the petitioner has been falsely implicated in the present case on account of protest raised by him against the jail administration with regard to quality of food.

5. Learned APP for the State opposed the prayer for anticipatory bail on the ground that the petitioner has five criminal antecedents. However, it is submitted on behalf of the petitioner that petitioner is on bail in all the cases.

Taking into consideration the facts and circumstances of the case and also considering the fact that although the petitioner had remained in custody during the period from 10.08.2020 to 30.03.2023, he was not remanded in the said period and further considering the fact that the recovery of SIMs were made from his prison cell and not from personal possession, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Hajipur Sadar P.S. Case No. 555 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
