S. Case No. 71 of 2019, registered for the offences punishable under Sections 341, 323, 384, 307, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R. petitioner and others went to the shop of the informant and they negotiated with the purpose of purchase of asbestors, upon which, the informant shown its inability to give on credit, thereafter some altercation took place, thereafter, accused persons fired on the informant, causing injury to his mother.

Submissions of the learned counsel for the petitioner is that no fire arm injury was found on the mother of the informant and as a matter of fact, there was some altercation with respect to fixation of rate, due to which, he has falsely been

Patna High Court CR. MISC. No.76044 of 2019(2) dt.25-11-2019 2/2 implicated in this case. He is in custody for four months. The charge sheet has already been submitted.

Heard learned APP for the State also.

Having heard both sides, considering the submissions, made above, this application is allowed. Let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Mahepura, in connection with Gamharia P. S. Case No. 71 of 2019, with condition that he has to co-operate in disposal of the trial.
