2. The petitioner is in custody since 14.07.2023 in connection with Jainagar P.S. Case No. 303/2023 registered for the offence punishable under Sections 272/273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 193 litres of illicit liquor has been recovered from the Scorpio vehicle.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.72713 of 2023(2) dt.09-11-2023 2/2 behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise at Madhubani in connection with Jainagar P.S. Case No. 303/2023.

7. The petitioner is directed to mark his attendance in Khajauli police station on 1st Sunday of every month.

8. It is made clear that any default in appearance in the aforesaid police station, as directed, would result in cancellation of bail bond of the petitioner.
