The petitioner seeks bail in a case registered under Sections 307, 323, 325/34, 341, 354B, 379, 447, 504, 506 of the Indian Penal Code.

Allegation against the petitioner is that the assaulted the informant with iron rod causing injury on his head and he also snatched golden chain, watch and Rs.2000/- from the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.8.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case and counter case between the

Patna High Court CR. MISC. No.66871 of 2019(2) dt.22-10-2019 2/2 parties. Counter case is Annexure 3 to the present application. Due to family dispute the alleged occurrence is said to have taken place. The injuries sustained on the accused side have not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dalsingsarai, Samastipur in connection with Ujiarpur P.S. case No.339 of 2018.
