The petitioner seeks bail in Bihiya P.S. Case No.182 of 2018, Excise Case No.819 of 2018 registered under Sections 30, 33, 36 of the Bihar Prohibition and Excise Act, 2016. The police got information that the petitioner and his accomplice had kept spirit in the old PACS godown on such a raid was conducted. The police found the petitioner and his two associates fleeing from there.
Learned counsel for the petitioner submits that the petitioner is not the owner of the PACS godown. There is nothing on record that the petitioner is owner of PACS godown and he has kept spirit in the PACS godown. About 245 liters of spirit was recovered from the PACS godown.
Patna High Court Cr.Misc. No.58522 of 2018 (2) dt.20-09-2018 Considering the facts aforesaid and the fact that petitioner is not owner of PACS godown, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.5,000/-(Five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhojpur, Ara in connection with Bihiya P.S. Case No.182 of 2018, Excise Case No.819 of 2018.
