2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 324, 307, 504, 506 and 34 of the Indian Penal Code and 27 of

Patna High Court CR. MISC. No.72778 of 2023(2) dt.07-11-2023 2/3 the Arms Act.

3. On the alleged date and time of the occurrence all the accused persons including these petitioners armed with various weapons came at the place of occurrence and due to dispute over ancestral land an altercation took place between the parties. It is further alleged that petitioner No. 2 has assaulted one Golden Singh with sword due to which he sustained grievous injury and so far as, petitioners Nos. 1, 3 , 4 and 5 are concerned there is general and omnibus allegation of assault against them.

4. Considering the fact that injury caused by petitioner No. 2 is grievous in nature , prayer for pre-arrest bail of the petitioner No. 2 is rejected.

5 . Considering the fact of the case and also the fact that there is general and omnibus allegation of assault against 1, 3 , 4 and 5 , in the event of arrest or surrender within six weeks from today, let the petitioner Nos. 1, 3 , 4 and 5 , as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class, Munger in connection with Dharahra P.S. Case No. 137 of 2023 , subject to the conditions laid down
