2. The petitioner seeks bail in connection with Madhwapur P.S. Case No. 112/2025 registered for the offences punishable under Sections 274, 275, 3(5) of the B.N.S. and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 900 liters of illegal Nepali country-made liquor was recovered from a Mahindra pick-up van. The police apprehended the driver of the said vehicle who disclosed his name as Vikram Kumar Mahto (petitioner).

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submits that the petitioner

No.70473 of 2025(3) dt.13-10-2025 2/2 is only the driver of the said vehicle and he has no concern with the alleged recovered liquor and he was driving the said vehicle on the instruction of the owner. Learned counsel further submits that petitioner has clean antecedent and he is in custody since 14.08.2025.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Act, Madhubani in connection with Madhwapur P.S. Case No. 112 of 2025.
