The petitioner apprehends his arrest in connection with Rajpur P.S. Case No. 130 of 2019 (G.R. No. 535 of 2019, registered under Section 30(a) of the Bihar Excise and Prohibition Act.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He further submits that nothing has been recovered from the conscious possession of the petitioner. The petitioner has no criminal antecedent. Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioner and submits that recovery of illicit liquor has been made from house of the petitioner.
Patna High Court CR. MISC. No.68840 of 2019(3) dt.18-12-2019 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I am not inclined to grant bail to the petitioner.
Accordingly, this application is rejected.
