The petitioner seeks bail in Sadar P.S. case no. 279 of 2018 instituted for the offence under Section(s) 392 Indian Penal Code.
Learned counsel for the petitioner has submitted that matter has now been compromised between the parties. Compromise petition has been filed in the Court below which is annexed as Annexure-2 to the bail petition. Petitioner has clean antecedent.
In the written report, it is alleged that informant was coming from bank after withdrawing cash of Rs. 18,000/-. Two persons intercepted him and snatched his money. It is
Patna High Court Cr.Misc. No.56813 of 2018(2) dt.28-09-2018 2/2 alleged that this petitioner was apprehended and one person managed to run away. Petitioner disclosed the name of another co accused as Pushpendra Kumar.
From perusal of Annexure-2, it appears that both parties have now compromised the case and compromise petition has been filed in the Court below.
Petitioner is in custody since. 12.7.2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Darbhanga, in connection with Sadar P.S. case no. 279 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
