Petitioners pray for bail in connection with Sanjhauli P.S.Case No. 26 of 2016 registered for the offences punishable under Sections 304/34 of the Indian Penal Code. Allegation as per FIR is that the petitioners, who are Supervisor and Contractor of the Electricity Department, were engaged in electrification work and the deceased Arvind Kumar was working on pole where electric wire was lying there and due to returning current from wire he fell down from the pole and died. Submission of learned counsel for the petitioners is that they were not knowing about the electric current was passing through the wire and they have falsely been implicated in this case
Patna High Court Cr.Misc. No.57734 of 2018 (2) dt.28-09-2018 2/2 and they are in custody since 23.7.2018 and moreover the matter has been compromised between the parties.

Having heard both sides and in the facts and circumstances, as stated above and since charge sheet has been submitted in this case, let the petitioners, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bikramganj, District Rohtas, in connection with Sanjhauli P.S.Case No. 26 of 2016, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
