JUSTICE MADHURESH PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are accused in a case registered for offence under section 307 and other allied sections of the IPC on the allegation that they and others pelted stone on the immersion procession of Goddess Durga idol.

Counsel for the petitioners submits that there is general and omnibus allegation and prior to the lodging of this case, they are not accused in other case. Similarly situated co-accused Md. Imroz Alam and Md. Iman have already been granted bail vide order dated passed in Cr Misc Nos. 61761 and 61770 of 2017 and the petitioners are in custody since 3.10.2017. In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let all the four petitioners above

Patna High Court Cr.Misc. No.733 of 2018 (2) dt.11-01-2018 2/2 named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Jamui Police Station Case No. 321 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners.

(b) They will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
