The petitioner apprehends his arrest in connection with Kishanpur P.S. Case No. 129 of 2018, registered under Sections 341, 323, 447, 448, 378, 420, 354, 504 and 354A/34 of the Indian Penal Code.

The accusation is that in the morning of 13.05.2018, Arun Kumar Mishra (petitioner) and his wife, Bandana Kumari, came at the house boarding on motorcycle and thereafter, both started to cause assault through lathi and Dabia. In the meantime, four persons also came there boarding on two motorcycles, out of whom, two caught hold him and two others also caused assault to him. At that time, petitioner tied Gamcha

In the meantime, wife of the petitioner snatched gold ear ring from the ear of his wife. The cause of occurrence is land dispute. Learned counsel for the petitioner submits that petitioner and the informant are agnates and due to land dispute, the informant has lodged the present case with false allegation. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul, in connection with Kishanpur P.S. Case No. 129 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
