JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2018 The petitioner is in custody since 25.04.2017 in connection with Sessions Trial No.468 of 2017 arising out of Lauriya P.S. Case No.102 of 2017, registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected on 23.11.2017 passed in Cr. Misc. No.44191 of 2017 and the allegation is of causing death of his wife.
Submission of learned counsel for the petitioner is that there is no direct evidence in this case and petitioner is in custody for one and half years.
Heard learned A.P.P. also.
Considering the aforementioned facts and circumstances,
Patna High Court Cr.Misc. No.56505 of 2018 (2) dt.12-09-2018 2/2 I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. However, learned trial court is directed to expedite the trial and if possible, to conduct on the regular basis.
