Prayer is for grant of anticipatory bail on behalf of the petitioners who are accused(s) in Baniyapur P.S. Case No. 123 of 2017 registered under sections 307 IPC.
On a trivial issue, it is alleged, both parties fought. The allegation in the FIR against petitioner no.1 is of causing injury with a Tangi on the head of the informant whereas petitioner no.2 is said to have caused injury in the right leg of the informant. Referring to the counter version, it is stated that, in fact, both parties had quarrelled over cutting of trees and both parties suffered injuries.
Counsel for the State, on the other hand, submits that petitioner no.1 is alleged to have assaulted on the head. The
Patna High Court Cr.Misc. No.2660 of 2018(2) dt.15-01-2018 2/2 doctor found injury on the parietal region.
Considering the background of the case, the allegation and other materials reflected from the record, prayer for bail made on behalf of petitioner no.1 is rejected.
Let petitioner no. 2 above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Saran, Chapra in Baniyapur P.S. Case No. 123 of 2017 on condition that one of his bailors shall be his own/close family member.
