Mr. Smt Renu Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 01.05.2018 in connection with Sakatpur Police Station Case No. 23 of 2018, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that petitioner is in custody in connection with seizure of total 28 liters of liquor. He submits that nothing was recovered from conscious possession of the petitioner. He submits that similar circumstanced co-accused Sachin had already granted bail vide order dated 28.6.2018 in Crl. Misc. no. 36106 of 2018.

No.54893 of 2018(2) dt.28-09-2018 2/2 Considering the aforesaid facts that the petitioner has no criminal antecedent and co-accused of this case namely Sachin has already been granted bail by this Court vide order dated 28.6.2018 in Crl. Misc. no. 36106 of 2018, let the petitioner named above to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Sessions Judge IVth, cum Special Judge, Excise Act, Darbhanga in connection with Sakatpur Police Station Case No. 23 of 2018.
