JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 This is an application for grant of anticipatory bail in connection with Sikrahatta P. S. Case No. 96 of 2019 disclosing offences under Sections 406, 420, 120B of the Indian Penal Code and Section 7 of the Essential Commodities Act As per prosecution case, a pick-up van was intercepted with 60 bags of rice, which appears to be a public distribution system and it is said that as the petitioner is the local Public Distribution System dealer, as such, he is engaged in the black marketing.
Submission of the learned counsel for the petitioner is that the whole case has been filed only on the presumption, most of the witnesses examined during the investigation have stated that they have got the rice from PDS dealer. Further petitioner is ready to abide by any condition imposed on him. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Ara, in connection with Sikrahatta P. S. Case No. 96 of 2019.
