2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 341, 323, 307, 302, 504 and 34 of the Indian Penal Code.

3. As per FIR, allegation against the petitioner along with other co-accused persons is that they came at the house of the informant and started abusing and assaulting the mother of the informant due to which she sustained injuries on her nose and left side of eye. During course of treatment, the mother of the informant died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in this case due to previous enmity.

No.72220 of 2023(2) dt.03-11-2023 2/2 There is no specific overt act of assault has been levelled against the petitioner rather general and omnibus allegation has been attributed against her. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, similarly situated other co-accused person has already been granted bail by this Court vide order dated 05.10.2023 in Cr. Misc. No. 62530 of 2023. Moreover, the petitioner is languishing in judicial custody since 18.08.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts that petitioner being a lady and her period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Itarhi P.S. Case No. 81 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-IV, Buxar.
