The petitioner seeks bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 20, 22 and 29 of the N.D.P.S. Act.

It is contended that, as per allegation, 31.5 litres foreign liquor was recovered from the bag of the petitioner. It is further contended that nothing was recovered from the possession of the petitioner and he has falsely been implicated in this case merely on the basis of suspicion. It is urged that other co-accused persons, namely, Pintu Rai, Mukesh Kumar & Anr. and Anirudh Kumar have already been granted bail by different Benches of this Court vide order dated 20.09.2018

Patna High Court Cr.Misc. No.59395 of 2018(2) dt.06-10-2018 2/2 passed in Cr. Misc. No.58699 of 2018, order dated 20.09.2018 passed in Cr. Misc. No. 54407 of 2018 and order dated 28.09.2018 passed in Cr. Misc. No.56830 of 2018 respectively. Petitioner claims that he is having clean antecedent and is in custody since 07.07.2018.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Patna in connection with Special Case No.- 6221 of 2018, G.R.P. (Patna Junction) P.S. Case No. 222 of 2018.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
