The petitioner seeks anticipatory bail in Hajipur Town P.S. Case No.486 of 2018 instituted for the offences under Sections 295(a), 153(a) and 34 of the Indian Penal Code and Section 67 of the Information Technology Act. Allegation has been made against the petitioner that he has made a statement and made it viral with regard to the communal tension.

Learned counsel for the petitioner an First Information Report has been lodged against the Mumtaj @ Kallu Mian, Shah Alam, Miraj and Shiraj for assaulting the informant. He has placed reliance on the Panchayati held between the parties

Patna High Court Cr.Misc. No.58937 of 2018 (2) dt.06-10-2018 2 /2 (Annexure 3).

In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of four weeks from today, the court below will pass an order on its own merit on the same day without being prejudiced by the order passed by this Court.
