The petitioner seeks bail in a case registered under Sections 448, 341, 307 of the Indian Penal Code. Allegation against the petitioner is that he assaulted the son of the informant by means of garasi on his head, due to which he received head injury. He was taken to the Hospital for treatment.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.07.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case and counter case between the parties. The accused persons were trying to misbehave with the
Patna High Court CR. MISC. No.67366 of 2019(2) dt.22-10-2019 2/2 niece of the petitioner. Hence to protect the niece, he protested upon the accused persons. The counter case is Annexure 2 to the present application.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Purnea in connection with Bhawanipur P.S. case No.11 of 2019.
