2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 420, 406, 409 and 34 of IPC .
3 . As per the prosecution case , informant, namely Nitesh Kumar, alleged that under the Chief Minister, Nal Jal Yojana Scheme , the total estimated amount was of Rs. 14,98,400, in which Rs. 13 lakh was transferred to the concerned wards, and the same was defalcated by the then Mukhiya, Panchayat Secretary, Ward Chairman, and Ward Sachiv of Ward No. 15, along with other accused persons, and several irregularities were

4. It is submitted on behalf of petitioners that at the relevant time, petitioner No. 1 was Chairman , and petitioner No. 2 was a member of Ward No. 13. From a bare perusal of the Inquiry report, vide letter No. 1096 dated 24.06.2022, it is manifest that the Nal Jal Yojana , was found functioning in the houses of Ward No. 13, and only some of the pipes were found damaged due to repairing of the road. It is further submitted that work in question has already been completed and the measurement book was also verified by the Inquiry team, and the same was found correct, and as such, there were no irregularities found in ward No. 13 . Petitioners claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the aforesaid facts, report of the Enquiry team, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM - I,
