JUSTICE SANJAY PRIYA ORAL ORDER 05-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Dinara P.S. Case No. 93 of 2017 instituted for the offence under Section 307/34 of the Indian Penal Code. Subsequently, Section 27 of the Arms Act was added.

Counsel for the petitioner submits that other coaccused persons have been granted bail by different coordinate Benches of this Court vide orders dated 16.01.2018 and 02.02.2018 passed in Cr. Misc. 57042 of 2017 and 4951 of 2018 respectively.

In the written report it is alleged that on the date of occurrence six accused persons including petitioner armed with weapons were watching the dance programme performed by the

Patna High Court Cr.Misc. No.56586 of 2018 (2) dt.05-10-2018 2/2 informant herself. In course of watching the dance, all the six accused persons made firing. One of the bullet hit the dancing girl on account of which, she became unconscious whereas one boy had also received gun shot injury.

From the written report it appears that it is not specific where fire hit the dancing girl, as a result of which, she sustained injury.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Lal Bihari Paswan, learned Judicial Magistrate-1st Class, Bikramganj (Rohtas) in connection with Dinara P.S. Case No. 93 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
