JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-10-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 9.8.2017 passed in Cr.Misc.No. 33344 of 2017 and there is allegation against the accused persons, including the petitioner of firing.

Submission of learned counsel for the petitioner is in petitioner is in custody since 13.4.2017 and charge has not been framed as yet and though witness in paragraph-18 of the case diary has taken name of the petitioner as assailant but the statement has been recorded much after lodging of the case and other witness in paragraph 19 of the case diary has stated about all the accused persons of firing.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail

Patna High Court Cr.Misc. No.61633 of 2018 (2) dt.03-10-2018 2/2 on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Saharsa, in connection with Sessions Trial No. 79 of 2018, arising out of Basnahi P.S.Case No. 33 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear before trial court as and when required, otherwise his bail bond shall be cancelled.
