2. The petitioner seeks regular bail in the present case registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act as well as Section 317(5) of the BNS, 2023.

3. As per the prosecution case, 397.440 liters of foreign illicit liquor has been recovered.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 06.08.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the

Patna High Court CR. MISC. No.75059 of 2024(3) dt.30-10-2024 2/2 case, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-IV-cum-Exclusive Special Excise Court No. II, Gopalganj/concerned Court below in connection with Kuchaikote P.S. Case No. 337 of 2024 subject to condition that:- 7(i). The petitioner will mark his attendance at the Mufasil Police Station Samastipur on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
