The petitioner, who is in custody, seeks bail in connection with Pandaul P.S. Case No. 149 of 2000 Corresponding to G.R. No. 1684 of 2000 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
Petitioner is not named in the FIR. Nothing has been attributed against petitioner and charge sheet No. 1 of 2001 was submitted against the FIR named accused persons on 17.01.2001. Since the petitioner is not named in the FIR and nothing was found against him and police did not submitted charge sheet against him. Statement under Section 164 of
Patna High Court Cr.Misc. No.55012 of 2018(2) dt.04-10-2018 2/2 Cr.P.C. of Sunita Devi was recorded in which she did not take the name of petitioner. She had taken the name of Bhola Nath Chaudhary, who has already been granted bail by this Hon'ble Court passed in Cr. Misc. No. 14498 of 2001 vide order dated 09.08.2001 and two non-FIR accused have also been granted bail by this Hon'ble Court and some other co-accused have been granted bail by the court below itself. Petitioner has no criminal antecedent and he is in custody since 12.07.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, VII, Madhubani, in connection with Pandaul P.S. Case No. 149 of 2000 Corresponding to G.R. No. 1684 of 2000.
