29-01-2020 Heard learned counsel for the parties.

The petitioner seeks bail in Chiksaura P.S. Case No. 53 of 2019 registered for the offence under Section 392 of the Indian Penal Code.

In the F.I.R., the informant has alleged that while he with co-villager was returning on motorcycle to their house, four unknown accused persons surrounded them and snatched his wallet, containing twenty thousand cash, Aadhar card, Pan card and Voter I-card as well as his mobile and from his covillager, one mobile phone was snatched. It is submitted on behalf of the petitioner that F.I.R. was lodged against unknown and during course of investigation on suspicion, petitioner's name has come. It is further submitted

No.64245 of 2019(3) dt.29-01-2020 2/2 that no incriminating article has been recovered from the possession of petitioner and till date, petitioner has not been put on T.I.P. In this case, chargesheet has already been submitted and there is no allegation of tampering with the evident. The The petitioner is in custody since 11-07-2019, having no criminal antecedent.

Considering the aforesaid facts and circumstances as well as nature of accusation, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-1, Hilsa (Nalanda) in connection with Chiksaura P.S. Case No. 53 of 2019 on the following conditions: "(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
