JUSTICE SANJAY PRIYA ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Gaurichak P. S. Case No. 134 of 2018 instituted for the offence under Section(s) 341, 323, 504, 506 and 354(B)/34 Indian Penal Code and Section 8 of POCSO Act.
Learned counsel for the petitioner has submitted that petitioner has no criminal antecedent. He has voluntarily surrendered on 4. 8.2018 and since then he is in custody. In the written report, there is allegation that this petitioner misbehaved with the daughter of the informant and when the informant raised objection then she was also abused by the petitioner .

Learned counsel for the informant has appeared and opposed the prayer. He has submitted that victim has given her statement u/s 164 Cr.P.C.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-1, Patna cum Special Judge, POCSO, in connection with Gourichak P.S. case no. 134 of 2018, corresponding to Special POCSO case no. 91/18 subject to the condition that both the bailers shall be the close relative of the petitioner.
