JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-02-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Laheri PS case no. 129 of 2017 registered for the offences punishable under Sections 406, 409, 420, 467 and 468 of the Indian Penal Code.

The allegation is regarding the informant having given a sum of Rs.4,50,000/- approximately to the petitioner and two other accused persons for depositing in the Central Bank Staff CoOperative Limited, however, the informant did not get this money back even after maturity of the fixed deposit and the petitioner started evading the informant.

The learned counsel for the petitioner submits that admittedly

Patna High Court Cr.Misc. No.294 of 2018 (5) dt.23-02-2018 2/2 the money was deposited in the Bank and the certificate was granted by the Branch Manager of the Bank, who has already been granted bail by this Court.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Nalanda at Biharsharif in connection with Laheri PS case no. 129 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
