JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Aurangabad Town P.S. Case No. 99 of 2018, registered for the offences punishable under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153 (A), 295 (A), 379, 122 (B) of the Indian Penal Code.

Petitioner happens to be a member of unlawful assembly, which engaged in the battle between two community. Submission of the learned counsel for the petitioner is that he is aged about 70 years and except the name in the F.I.R there is no specific allegation against him. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above

Patna High Court CR. MISC. No.64981 of 2019(2) dt.18-10-2019 2/2 named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Aurangabad, in connection with Aurangabad Town P.S. Case No.-99 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
