The petitioners apprehend their arrest in Jamui Adarsh P.S. case No. 247 of 2019 registered under Section 379 of the IPC.

The informant named the petitioners and suspected that the petitioners, who were painting the house, committed theft of ornaments from his house.

The learned counsel for the petitioners submits that the occurrence took place on 05.05.2019 but the FIR was lodged on 11.05.2019. The informant on mere suspicion alleged that the petitioners, who were doing work of painting in his house, might have committed theft and lodged the case. Nobody has

Considering the facts aforesaid and nature of allegation made against the petitioners and the fact that except suspicion there is no material to show that petitioners committed theft of ornaments in the house of informant, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui Adarsh P.S. case No. 247 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
