1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2), 3(5) of the B.N.S.

3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 06.04.2025 at 10.00 P.M., accused Lal Bahadur, Bhola and Jogi came and started abusing and assaulting him in a drunken condition, but the informant

Patna High Court CR. MISC. No.68085 of 2025(2) dt.13-10-2025 2/3 managed to enter his house, thereafter accused persons came and Bhola assaulted him by an iron rod causing injury on head thereafter Jogi assaulted his mother by lathi causing injury on head.

4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that specific allegation of assault is against Bhola and Jogi and as far as petitioners are concerned, no specific allegation of assault is alleged against them. It is also submitted that petitioners are not criminals.

5. Learned A.P.P. Sri Chandra Bhushan Prasad opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Motihari, East Champaran in connection with Sugauli P. S. Case No.164 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
