The petitioner, who is in custody, seeks bail in a case registered under Sections 419, 420, 290 of the Indian Penal Code, Section 3⁄4 of the Bihar Lottery Regulation Act and Section 37 (C ) of the Bihar Prohibition and Excise Act 2016 in connection with Alamganj PS Case No. 589 of 2019 (Special Case No. 7265 of 2019).
The allegation is that the petitioner has been apprehended while indulging in illegal guessing (gambling) and that he was intoxicated.
Petitioner's Counsel submits that he was falsely implicated as he had come to his village on casual leave after obtaining leave from his service in the Border Security Force.
Patna High Court CR. MISC. No.67823 of 2019(3) dt.25-11-2019 2/2 Petitioner is in custody since 15.8.2019. Petitioner has no criminal antecedent.
Learned APP for the State has opposed the prayer for bail.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in Alamganj PS Case No. 589 of 2019 (Special Case No. 7265 of 2019) subject to the conditions:- (I) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner. (ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled.
