Learned senior counsel appearing on behalf of the petitioner submits that some of the accused persons have been granted the privilege of anticipatory bail by this Court in the present case, as such seeking parity, it is submitted that petitioner be also granted the privilege of anticipatory bail, on which the learned counsel appearing on behalf of the Bank submits that the accused who were granted the privilege of anticipatory bail by this Court were given clearance by the vigilance wing of the bank whereas the case of the petitioner is pending consideration before the vigilance branch of the bank. It is also submitted by the learned counsel appearing on behalf of
Patna High Court CR. MISC. No.73429 of 2024(5) dt.12-02-2025 2/2 the Bank that he has instructions that the vigilance wing of the Bank will conclude the proceeding within three months from today.
3. At this stage, the learned senior counsel appearing on behalf of the petitioner seeks permission to withdraw the anticipatory bail application with liberty to move afresh in the event if the vigilance wing of the Bank exonerates the petitioner.
4. Permission, as prayed for, is accorded.
5. Accordingly, the instant anticipatory bail is disposed of as withdrawn with the liberty aforesaid. (Prabhat Kumar Singh, J) shashank/- U T
