Heard learned counsel for the petitioner no.3 and the State.

Petitioner no.3 apprehends arrest in a case registered for the offence punishable under section353, 504,506,120B,332, 333 and other ancillary sections of the Indian Penal Code. Prosecution case is that the petitioner and other accused persons attacked the police men, threw chili powder and damaged articles of neighbouring people. It is further alleged that they created hindrance in enforcement of law and order by the police.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.68664 of 2022(2) dt.20-03-2023 2/2 petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner and no specific overt act has been alleged against him. Petitioner has got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner no.3 mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Paharpur Police Station Case No. 258 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
