2. Petitioners are in custody in a case registered for the offence punishable under Section 317(5) of the BNS.
3. As per allegation in the FIR, the informant with
Patna High Court CR. MISC. No.68464 of 2025(4) dt.18-12-2025 2/3 squad on special checking duty got secret information that some persons are assembled for sale of stolen motorcycle. The informant reached at Nizamatpur Bagicha and by fetching caught six persons.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. He next submits that petitioners have no knowledge about the said recovery of motorcycles and nothing has been recovered from the possession of the petitioners. He next submits that name of the petitioners have been transpired on the basis of confessional statement of other co-accused person. He submits that petitioner are in custody since 04.05.2025 and has got no criminal antecedent as stated in para-3 of the bail petition.
5. Learned APP for the State opposes the prayer for bail of the petitioners.

On perusal of the FIR, case diary and impugned order dated 28.08.2025, it appears that petitioners, namely, Chandan Kumar and Pintu Kmar @ Pintu Rai have got no criminal antecedent and they have been in custody since 04.05.2025. So, considering the aforesaid facts and circumstances of the case and submission of learned counsel for the petitioners, let the
Patna High Court CR. MISC. No.68464 of 2025(4) dt.18-12-2025 3/3 above-named petitioners be released on bail, on their furnishing bail bonds of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Patna City in connection with Didarganj P.S. Case No.145 of 2025.
7. So far as petitioner, namely, Ranjan Kumar @ Ranjan Ray is concerned, it appears that on the basis of his confessional statement and on his instance the 18 motorcycles were recovered, so I am not inclined to grant bail to the petitioner, namely, Ranjan Kumar. @ Ranjan Ray.
8. Accordingly, the prayer for bail of petitioner, namely, Ranjan Kumar. @ Ranjan Ray is hereby rejected.
9. However petitioner, namely, Ranjan Kumar @ Ranjan Ray is directed to renew his prayer for bail after completion of one year of custody before the learned Trial Court.
