Petitioner seeks bail in connection with S.T. No. 98 of 2018, arising out of Kotwali P.S. Case No. 616 of 2017 registered for the offence punishable under sections 364A and 307/34 of the Indian Penal Code and Section 27 of Arms Act. Petitioner has earlier moved this Court for grant of bail in Cr. Misc. No. 62460 of 2017, which was rejected vide order dated 16.02.2018 (Annexure-1).
Learned counsel appearing for the petitioner submits that the fresh ground on which the petitioner had renewed his prayer for bail is that charge have also been framed against this petitioner. Moreover, similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court vide
Patna High Court Cr.Misc. No.58382 of 2018(2) dt.28-09-2018 2/2 order dated 26.06.2018 passed in Cr. Misc. No. 18998 of 2018. Petitioner has no criminal antecedent and is in custody since 11.09.2017.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Bhagalpur in connection with S.T. No. 98 of 2018, arising out of Kotwali P.S. Case No. 616 of 2017. (Arvind Srivastava, J) mcv/-Sanjeev U T
